To make a warranty claim, the customer must inform Barska in writing before the Warranty Period expires. Upon receiving this notification, Barska will conduct an investigation into the warranty claim. If the investigation confirms the validity of the Equipment or Product warranty claim, Barska will, at its discretion and at no additional cost to the customer, either:
1. Repair the defective Equipment or Barska Product.
2. Replace it with the same or an equivalent product.
3. Refund the price of the defective Equipment or Barska Product.
These actions represent the full extent of Barska's liability for the warranty claim. In the case of a valid Services warranty claim, the customer's sole recourse is to request Barska to either re-perform the non-conforming service or provide a pro-rata refund of the fees paid for the non-conforming Service.
If the investigation determines that the warranty claim is not valid, Barska may invoice the customer for the time and materials used to respond to the claim, based on Barska's prevailing labor rates at the time.
Any repaired or replaced products are covered by warranty for the remaining duration of the original applicable warranty period. All replaced products or parts will become the property of Barska.
